1. Introduction

These Terms constitute a legally binding agreement between you and the Company, governed by the laws of the Pakistan. If you do not agree to these Terms, you must immediately discontinue use of our Services.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Pakistan, including but not limited to:

        The E-Commerce Law issued

        The Personal Data Protection Law (PDPL)

        The Anti-Cyber Crime Law

        The Consumer Protection Law and its implementing regulations

        Any applicable regulations issued by the Pakistan

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Pakistan, or referred to arbitration in accordance with the Paksiatn Arbitration Law, as deemed appropriate.

 

3. Eligibility & User Obligations

By using our Services, you represent and warrant that:

        You are at least 18 years of age or have obtained legal guardian consent as required under Pakistan law;

        You have the legal capacity to enter into a binding agreement under Pakistan law;

        You are not prohibited by any applicable law from using our Services;

        You will comply with all applicable Pakistan laws, regulation;

        You will not use the Services for any purpose that violates Islamic values, public order, or national security.

 

4. Description of Services

Alshallalmarket.com provides an online marketplace for the sale of products to customers across the Pakistan. The Company reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice, subject to applicable Pakistan regulations.

 

5. Account Registration & Security

To access certain features, you may be required to register an account. You agree to:

        Provide accurate, current, and complete information during registration;

        Maintain the security and confidentiality of your account credentials;

        Notify the Company immediately of any unauthorized use of your account;

        Comply with national identity verification requirements under Pakistan law (e.g., National ID where applicable);

        Take full responsibility for all activities conducted under your account.

 

6. Privacy & Personal Data Protection

The Company is committed to protecting your personal data in full compliance with the Personal Data Protection Law (PDPL) of the Pakistan. By using our Services, you acknowledge that:

        We collect and process personal data only for lawful, specified, and explicit purposes;

        Your data will be stored securely within compliant data centers, with cross-border transfers subject to SADAIA approval where required;

        You have the right to access, correct, delete, or request portability of your personal data;

        We will not sell, rent, or disclose your personal data to third parties without your consent, except as required by Pakistan law or competent authorities;

        Data retention periods comply with the PDPL and relevant sector regulations.

7. E-Commerce, Payments & Consumer Rights

Where our Services involve the sale of goods or services, the following provisions apply in accordance with the Pakstan Law and Consumer Protection Law:

7.1 Pricing & Payments

        All prices are displayed in Pakistani Rupees (PKR) and include VAT;

        Payments must be made through secure, approved payment gateways licensed in the Pakistan;

        Receipts and tax invoices will be issued electronically in compliance with  requirements.

7.2 Returns & Refunds

        Consumers have the right to return products within seven (7) days of receipt in accordance with the Consumer Protection Law, provided the item is unused and in its original condition;

        Refunds will be processed within a reasonable period, not exceeding fifteen (15) business days, subject to applicable deductions as permitted by law;

        Digital products and customized items may be exempt from return rights as specified at point of sale.

 

8. Prohibited Activities

Users are strictly prohibited from engaging in any of the following activities through the Services:

        Any activity that violates Islamic Sharia principles, public morals, or social values of the Pakistan;

        Publishing, transmitting, or distributing content that is offensive, defamatory, or contrary to national security;

        Unauthorized access, hacking, or interference with the Company’s systems, in violation of the Anti-Cyber Crime Law;

        Fraud, impersonation, money laundering, or financing of terrorism in violation of Pakistan AML/CFT regulations;

        Use of the Services for any unlicensed commercial or financial activity;

        Infringement of intellectual property rights protected under the Pakistan Copyright Law;

        Collection or misuse of other users’ personal data without lawful basis;

        Circumventing technical or legal access restrictions on the platform.

 

9. Intellectual Property

All content, trademarks, logos, software, databases, and materials available through the Services are the exclusive property of Alshallalmarket.com or its licensors and are protected under the Pakisan Intellectual Property Law, the Copyright Law, and the Trademark Law.

You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes only. Any reproduction, distribution, or modification of our content without prior written consent is strictly prohibited.

 

10. Limitation of Liability & Disclaimer

To the maximum extent permitted under Pakistan law:

        The Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services;

        The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied;

        The Company’s total aggregate liability for any claim shall not exceed the amount paid by you for the Services in the preceding three (3) months;

        Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded under applicable Pakistan law.

 

11. Force Majeure

The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, government actions, pandemics, cyber-attacks, or disruptions to telecommunications infrastructure within the Pakistan.

 

12. Amendments to These Terms

The Company reserves the right to amend these Terms at any time in compliance with applicable Pakistan laws and regulations. Material changes will be communicated to users via the registered email address or a prominent notice on the platform. Continued use of the Services after the effective date of any amendment constitutes your acceptance of the updated Terms.

 

13. Termination

The Company may suspend or terminate your access to the Services immediately and without prior notice if you breach any provision of these Terms, violate applicable Pakistan laws, or engage in conduct that may harm the Company, other users, or third parties. Upon termination, all licenses granted under these Terms shall immediately cease.

 

14. Complaints & Dispute Resolution

If you have any complaint or dispute regarding the Services, we encourage you to contact us first through our customer support channels to seek an amicable resolution. If a resolution cannot be reached, disputes shall be submitted to:

        The competent Pakistan courts in the city of islamabad;

        Or, where parties mutually agree, to arbitration under the Pakistan Arbitration Law  administered by the Pakistan Center for Commercial Arbitration (SCCA).

Consumers may also file complaints with the Ministry of Commerce, or the Communications, Space & Technology Commission (CST) where relevant.
